need a quality lawyer in Lexington/Versailles Kentucky that has knowledge of thoroughbred business...cannot get stallion owner to register breeding to my infoal mare...not sure why they won't do it.??....does not cost a penny !!..all fee's have been paid long ago !! Thanks

Any decent lawyer should do if you have a copy of the contract with the farm standing the stallion and the cancelled check or whatever where you paid the stud fee. It's a matter of simple contract law.
However if this is a mare you acquired in foal and you didn't get a stallion service certificate from the person you got the mare from then you would have to go after the person you got the mare from and not the farm - because the farm had no contract with you (only with whoever you got the mare from).

I remeber giving you some advice on how to proceed in another thread you started. You don't need a lawyer. If you have recoed of the payment and the contract send it to the jockey club and you will get your SERVICE CERTIFICATE which again is what you need to register the foal, they are either done online or mailed out around after the foal arrives and the stud fee paid. I don't know how you would know if it was or was not registered unless your mare was the only one bred to the stallion and it did not show up in the report of mares bred for 2008.
Bottom line if the stallion is registered with the Jockey Club, his DNA will be on file, same with your mare. Once the foal arrives do the DNA on it, show recoed of payment and the contract and the Jockey Club will register your foal regardless of co-operation of the stallion owner. Much easier than paying a lawyer a lot of money for nothing.
If you can't show any of the above than this story is even more suspect from both sides than I can already imagine.

This mystery really has got me going. There is a very simple solution, maybe we can do a Maury Povich show and have the mare, stallion and both owners on and do a DNA on the resulting foal. Then we can find out if your mare really was covered and inpregnated by the stallion you claim it was bred to and the Jockey Club can send you your Service Certificate. I know some lawyers would miss out on getting paid for doing nothing more than what people on this site have recommended you do...but it would make for great TV.

Seriously. What stallion owner or breeding farm out there, precisely, is so incompetent that they couldn't or didn't report the cover to the Jockey Club? What horse is it? What farm? It might be important to help other mare owners avoid what you are going through. Or are there two sides to this story?
Just an FYI, we do not send out service certificates until after the foal is born, unless the mare is sold or is put in an auction, at which time the live foal guarantee is terminated. The service certificate is the last "control," if you will, that the stallion owner has. If you have the certificate, you can claim stillborn or no foal and get a return cover, and end up with two foals. Additionally, having a file of those certificates with due dates, etc., is a great reminder to me to call and find out if they got a foal. I also call "my" breeders to remind them of things like KTDF nomination and other deadlines to save them money. I send the certificate out on a live foal only. It has been that way, also, with stud farms in Lexington I have dealt with. I call to report the live foal. They check the file, note the fee is paid, and send out the certificate or do an electronic release. It has always been thus. I think hiring a lawyer at this point is VERY premature. Your mare has not even foaled yet.

You have 365 days AFTER the birth of the foal to get the certificate and other requirements in without paying late fees, so I am going to suggest the stallion owner thinks you are a crazy stalker for annoying them for a "service cert" on something that doesn't exist. You have no access to any "Mares Covered" reports sent in by the stallion owner so why do you assume you are not on that list?

Thanks everybody......I am a rookie and am not aware the breeder can/ does or will issue certificate at their leisure--so what she is doing ia apparently OK...live foal or not--.certainly will never rebreed to any stallion at this farm---..I have the breeding statement /reciepts and will bypass stallion owner with your recommendations...and register myself..Thanks again

What??? Why would they be billing? They can't register your foal. The owner of the foal pays that when pics, cowlicks, and description is sent in. And if hair sample is good and payment paid, your foal gets registered. How would the shed be billing you for that. It has nothing to do with the stallion owner.
I am sure the shed won't miss you not returning. As far as I can tell, they have followed proper protocol and stcath95 is the one who is not understanding how the process works and accusing wildly when no crime has been committed.

Guess I wasn't clear---I paid for breeding...I know I pay for anything before or after that !!..Actually I paid for it all...they supplied the stallion as should have been and was !!!...it's all a done deal....I will register the champion !!!foal

THEY have not registered the breeding event...I did not understand they don't have to till the foal is delivered alive /nursing/standing...Aug 2008 was the month for stallion owner to report their breeding events to th JC..but my stallion owner has not done so...which leaves me perplexed...no fee;s to register breeding/ no guarantee live foal...I needed this for insurance registration...but my company accepts because I have PAID breeding paper and certified mare is in foal...Thanks
Maybe someday I'll be a better thoroughbred owner !!..almost wish I had gone into quarter horse breeding/racing..and still may do so !!!
