Looks like he will be appealing this ruling. I wonder how long he can continue with the appeal process?

NY says he can't. So, his lawyer(s) now say they will find a loophole which will let him appeal. Both sides are stomping feet and lowering their horns, ready to charge. It looks like a bull fight out is going to occur, unless Dutrow figures out it will cost money. This would disappoint some lawyers, of course.

Well if he cannot appeal his appeal why isn't his license revoked immediately? I don't get it..

The Dutrow decision rendered by the court was not made by the highest Appellate court of the State of NY. Any decision made by the Appellate Division may be appealed to the state's highest court, the New York Court of Appeals. This appeal does not have to be heard, it is up to either the lower appellate court or the NY Court of Appeals to decide whether there is a valid issue of law that could change the outcome of the decision by the lower court. Thanks TJ. I have no idea how NY law works. Based on your above I doubt if any further appeal will be heard so it sounds like Dutrow has less than six months to operate his NY stable. Likely his ban will be honored in all major racing states so he is definitely doing short time..

The NY Court of Appeals has rejected Dutrow's first appeal of suspension. Dutrow now has one option left, to pursue his appeal in the same court, via other legal grounds aside from the constitutional merit of the appeal on which it was rejected by the court. If the court refuses to hear this appeal, his current stay will be lifted and he will be forced to pursue any other appeals to the court while no longer being allowed to train horses.
