I would say dark bay, but it is hard to tell from a single picture considering horses' coat's get bleached out many times and from the look of his tail it looks more bleached than anything else....

There is no such thing as "dark bay" IMO.
That muzzle may be bleached, but not to that extent. That is a classic brown.

Not odd at all. Genetically there isn't IMO. 99.9% of all horses I've ever seen called "dark bay" are actually browns. Genetically they are either bay, or they're brown, there is no "in between".
