Thank you, casallc, for the opportunity to point out that this case was later thrown out, something which the Blood Horse never bothered to print. It was a very simple, yet extremely frustrating, matter in which I sold three young horses I bred to a man for $20,000 down and $20,000 out of earnings (a fairly common practice). One of them couldnt run, but the second broke her maiden and the third was very promising, winning two of his first three starts. Unfortunately his cowboy trainer started him three times in less than a month and broke him down. The buyer never sent me a dime towards his outstanding balance, which he was contractually obligated to do.
In the meantime the same man wanted to buy a broodmare with me so he send me five or six thousand dollars for 50% of a Summer Squall mare I recommended. When the mare vetted badly I cancelled the sale and applied the funds he had sent me towards what he owed me on the other three. It made perfect sense to me but not him. Thats when the SHTF. While the first ruling went against me (per the BH) it was later thrown out and I was very relieved. No fine, no jail (!!!) or anything else the BH story intimated.
