I am new to the board but wanted to share my bad start. I was told that the above stallion was mine and to setup the transport for him.I paid Lady L Ranch&Horse Transport a $450.00 deposit to get him delivered. She notified Oliva farms to pick him up. After the first attempt and no one was there to meet her they said reschedule it for later. Well the next couple of days i was told the stallion was no longer available. I cannot get my deposit back and no one will return my calls the transporter or Oliva Stables. I can see how some people quit the game...

I'm so sorry to hear this, Deacon! I wish I had more information to give you, but all I know about the horses and farm was what was posted in the original message here. Someone from the farm contacted a rescue group looking for help placing the horses, and after getting the forwarded message from the rescue, I offered to post here.

I have sent several emails and no replys . I called his office several times and spoke to his wife. She seem nice and said that she gave hime all messages to return my calls but never did. The transporter has change her number also. After doing a little research i found out sevral complaints had surfaced about their way of doing business. I really did not have that kind of money to be giving away.

Tooooo!!! bad things like this have to happen...they really don't 'HAVE' to happen but there are those few !!!...we need a section to maybe show trouble spots and who/whom not to deal with....this also reflects on the person who log's the message ...have sent plenty of emails about cheap to no cost horses and never heard a word....--why log up if you have no intention of not fulfilling the deal...at least a final message --'horse gone'

Stcath, if you're talking about me as the person who logged the message: as I said in the post to Deacon, I only heard about the NJ horses through another rescue (which the trainer's wife, I believe, had contacted directly asking for help placing the horses). I offered to post here to help get them more exposure. It's really a shame that a buyer (Deacon) was treated in such a manner.
Also, I don't have any PMs from you, I don't think; I always try to post a follow-up if I have news about a horse. Almost all the horses I post about are listed on CANTER - (I am a CANTER volunteer) - and if not CANTER listings, they are horses I've been notified about by another rescue. Unfortunately, sometimes trainers just never do tell us what happened to a particular horse, despite our best efforts to get answers.

This isn't a horse gone issue. Deacon12 spoke with and was told the horse was his. The person he spoke to might just as well have mugged him in the alley. At least Deacon12 could file a police report. The way it stands now even to get someone to represent him at small claims would cost as much as the judgement. This person will lie and say he never gave him the horse, so it's a no-win situation.
Hold on. The stallion owner who offered a free horse is not the one who cheated deacon out of $450, it was the shipper. I have never had to pay a deposit for shipping... but have heard of folks doing that. When someone offers free horses, it could be interpreted as a somewhat dire situation and horses are always first-come-first-serve. Not meaning to offer shoulda woulda coulda... but when the first contact about the stallion was made, it might have sealed the deal if an offer had been made to purchase the horse, or at least pay board from the moment the deal was made until shipping could be arranged. A simple one-page bill of sale or contract might have been done.
So Run for the Roses, as fast as you can.....

Am I correct in the way that I'm reading Deacon's first post... an attempt was made by the shipper to pick up the horse but nobody was there so the horse couldn't be picked up? IF that's the case, I don't blame them for keeping the deposit... it's not their fault that they went all the way to the farm and couldn't get the horse. In that case they're out gas money, time, wear and tear on the vehicle, etc... HOWEVER, if the shipper did NOT go try to pick up the horse, I don't understand why the deposit wouldn't be returned.

I was told by the owner of the transport service that i would get a partial refund.I was ok with that because i do not want nothing for free.The pickup was in the area where she was already picking up other horses. I found out afterwards that this transporter had other complaints and was removed off of the website listing where i got the quote and contact from.

This reminds me of a time when we were hired to haul for someone and went clear to another state to pick up the horse, only to have the barn owner refuse to let the horse go because they said the owner was behind on the board bill. Now, we had previously talked to the horse owner and the barn owner to arrange pickup, and this was not mentioned to us, because apparently the owner had promised to wire money to the barn owner to cover the board prior to us arriving. So, we were none the wiser. We do not charge a deposit when we haul, and we didn't bill the owner for the completely wasted trip, but I can imagine that a transport company that does this to pay their bills might have had a different way of looking at the scenario. In our case, both people were highly apologetic to us and we did not feel that this was in any way intentional, so we decided to let bygones by bygones. Luckily it was a neighboring state and not several states away!
