Curlin Now Has 418 New Owners

Great news for the "little guy". Those two legal extortion artists a.k.a. trial lawyers Galion and Cunningham that have been in prison as their extortion case was being revievwed by the 418 plaintiffs who brought the case regarding the diet drug Fen-Phen and the ultimate settlement of which plaintiffs accusse said defendents of stealing/overcharging by $64,000,000. Judge agreed with plaintiffs and turned Curlin over to them.


Propsal to sell Curlin appears imminent to settle all owner disputes and dissolve multiple ownerships surrounding the horse. Detail of sale are in the works... possibly private or perhaps at public auction


Now, what will Curlin bring? I'll say $29,000,000.

Even so, they own only 20%, they sure won't get the whole amount of money off of the sale. There are 2 other partners that own 80% of him. It is ultimately their final decision.

But I bet he goes to stud.

Hi All,
I brought this situation up in a previous post "whether Curlin would race again as a 4YO". It was obvious to me any real decision had to be put off till this case was decided. The right decision was made, yet unfortunately, it could send Curlin to stud now, along with the rest of the group. Todays racing is all about profit and the only way they make the big bucks is by getting the good ones safely off the track and into the breeding shed ASAP. I am sure this crop will prove through racing history, to be outstanding not only on the track but the breeding shed as well. I think Hard Spun may turn out to be the best of the lot at stud, he will be a very good stand in for Danzig. We, on the other hand, are just going to have to deal with that fact and forget about seeing the 3YO champs return as 4 YO's and focus instead on the new crop of 2yo's that come along. It is a different business now, but it is still the best around :>)

Hi Winds,
I was wondering if the 20% ownership retained by Midnight Cry is what the winners of this case recieve? Do you know if that % was negotiated in the settlement?
I would think a good lawyer could prove the original sale by Midnight Cry was null and void and Curlins ownership belongs to the plaintiffs. Am I getting crazy or does this make sense? TJ

Scratch that request, I just read the article in Bloodhorse. They got 20%, but I still think the original sale is null and void as Curlin wasn't theirs to sell. TJ

It would have been very hard to prove. The plaintiff would have had to trace the purchase moneys paid for Curlin by the jailed attorneys to the money that is alleged to have been misappropriated, rather than to the attorney's legitimate fees and costs, or other monetary assets. Obviously, since the 418 plaintiffs have accepted the 20% deal, they could not do that.

I wonder how the plaintiffs would feel if the horse continued running and got hurt in his first race back and then had to have surgery etc. They would have to pay on his expenses. I don't think they would like that. Everyone sees $$ signs and thinks they will get rich, not if he keeps running.

But, as it doesn't seem like that is going to happen, I guess they will get a portion of what is owed them.

By the way, I sure in no way wanted anything like that to happen to Curlin. I think he's an incredible horse. I wish none would breakdown.
