Is this guy a regular on the New Mexico circuit? Why hasnt the racing commission stepped in?

Not dealing with the issue of whether it makes the trainer look like a cheater, the bottom line is at NP the horse owner remains the owner of the horse even after it dies. The regulator if they want to make a claim on the carcass must do so within the context of the law. Being familiar with the authorities at NP, they are unfamiliar with the law and believe it does not apply to them. Their order to not remove the horse was likely not done appropriately and therefore the offending trainer will face no sanction if he has a lawyer that is minimally competent.

Only because most people don't care what happens to it after it dies. Property law is very well defined.

Dave, I could understand if it was a horse so and so had had in his/ her barn for years and has done nothing but good by them... I give someone that. BUT even in that scenario wouldn't you WANT to know why the horse went wrong? I would have zero issue with necropsy if my hands were clean. :wink:

I absolutely agree it looks suspicious, that doesn't make it illegal or a violation of the rules. If he took the insurance money and the body, then he has a problem. If he declined the insurance money then he just looks like a cheat but there isn't anything anyone can do about it.
