What is the JC rule on reusing names?

What is the JC rule on reusing names?
Does the horse have to be inactive or deceased for five years before the name is elligible again? Or am I way off? Thanks

The sire of my yearling is an actively breeding son of Storm Cat, he is registered with the JC as her sire, is just 10 years old, but still obviously active in breeding multiple mares, he lives in Lexington, yet I saw that they released the name to a 2009 colt.
I was confused when I saw this; I wrote the JC, but have heard nothing to date. His owner said that should not have happened as he is indeed registered as a stallion, and has, as I said, multiple foals both in Lexington and the East Coast.

The stallion that I'm talking about that sired my yearling and many other foals at the moment, was born in the USA. He was named on there (the JC names registry) and had his year of birth, 1998, and obviously when I sent in my filly's papers, I listed him as the sire and the papers were accepted right away.
Madelyn, LOL, does Pegram have some rules bent, maybe, for names?
